General Terms

Article 1 Scope of Application

  • Contracts for accommodation and related agreements to be entered into between this Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices.
  • In the case when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.

Article 2 Application for Accommodation Contract

  • A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
    • (1) Name of the Guest(s) and telephone number(s) (or, mobile telephone number[s]);
    • (2) Date of accommodation and estimated time of arrival;
    • (3) Accommodation charges (based in principle on the Basic Accommodation Charges listed in the Attached Table No. 1); and
    • (4) Other particulars deemed necessary by the Hotel.
  • If Guests request to extend their stay, during their stay, beyond the date in subparagraph 2 of the preceding Paragraph, the Hotel shall regard this as an application for a new Accommodation Contract at the time such request is made.

Article 3 Conclusion of Accommodation Contracts, etc.

  • A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply where it has been proved that the Hotel has not accepted the application.
  • When a Contract for Accommodation has been concluded in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay an accommodation deposit set by the Hotel within the limits of Basic Accommodation Charges covering the Guest's entire period of stay (3 days when the period of stay exceeds 3 days) by the date specified by the Hotel.
  • The deposit shall be first used for the Total Accommodation Charge to be paid by the Guest, secondly for cancellation charges under Article 6 and thirdly for reparations under Article 18 as applicable. The remainder, if any, shall be refunded at the time of payment for accommodation as stated in Article 12.
  • If the Guest fails to pay the deposit by the date as stipulated in Paragraph 2, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of payment of the deposit is specified.

Article 4 Special Contracts Requiring No Accommodation Deposit

  • Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.
  • In the case when the Hotel has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date of payment of the deposit at the time the application for an Accommodation Contract has been accepted, it shall be treated as though the Hotel has accepted a special contract prescribed in the preceding Paragraph.

Article 5 Refusal of Accommodation Contracts

  • The Hotel may not accept the conclusion of an Accommodation Contract under any of the following circumstances:
    • (1) The application is not carried out according to the Terms of Service.
    • (2) There are no available guest rooms due to full occupancy.
    • (3) When the Hotel deems that there is a risk that the person seeking accommodation will take actions regarding their accommodation that will violate the stipulations of laws and regulations, public peace and order, or accepted morality.
    • (4) The person seeking accommodation is acknowledged to be one of the following (a) to (c):
      (a) A criminal gang as defined in Item 2 of Article 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (referred to below as “a criminal gang"), a member of a criminal gang as defined in Item 6 of Article 2 of the same Act, or an associate member of a criminal gang, or a person related to a criminal gang or another anti-social force;
      (b) A corporation or other organization whose business activities are controlled by a criminal gang or criminal gang members;
      (c) A corporation that has among its corporate officers those who are deemed to be criminal gang members.
    • (5) When the person requesting Hotel accommodation is behaving in such a manner as to be an annoyance to other guests.
    • (6) The person seeking accommodation is obviously infected with a disease.
    • (7) When the person seeking accommodation makes intimidating and unreasonable demands involving such actions as violence, threats, and extortion against the Hotel facilities or Hotel facilities staff (workers), or imposes burdens that are beyond reason, or when it is deemed that they have done such.
    • (8) When accommodation cannot be provided due to natural disasters, damage to the facilities or other unavoidable circumstances.
    • (9) When the person seeking accommodation does not observe the provisions of these Terms of Service or when they do not observe the provisions for cancellation or provisions for payment at the time of placing their reservation.

Article 6 Right to Cancel Accommodation Contracts by the Guest

  • The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
  • If the Guest has canceled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has canceled before payment), the Guest shall pay cancellation charges as listed in the Attached Table No. 2. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of payment of cancellation charges in case of cancellation by the Guest.
  • If the Guest does not appear by 8:00 p.m. of the accommodation date without advance notice (2 hours after the expected time of arrival if the Hotel is notified), the Hotel may regard the Accommodation Contract as being canceled by the Guest.

Article 7 Right to Cancel Accommodation Contract by the Hotel

  • The Hotel may cancel the Accommodation Contract under any of the following circumstances:
    • (1) When the Hotel requests the particulars in Paragraph 1 of Article 2 to be clearly stated and these particulars are not forthcoming by the deadline.
    • (2) When payment of the accommodation deposit of Paragraph 2 of Article 3 is requested and payment is not made by the deadline.
    • (3) When circumstances corresponding to (3) to (9) of Article 5 occur.
    • (4) When the Guest does not observe prohibited actions such as smoking in bed, tampers with fire-fighting facilities and otherwise breaches Hotel Regulations stipulated by our Hotel.
  • If the Hotel has canceled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not charge the Guest for any of the services during the contractual period he/she has not received.

Article 8 Registration

  • The Guest shall register the following particulars the Front Desk of the Hotel on the day of accommodation:
    • (1) Name, age, sex, address, and telephone number(s) (or mobile phone number[s]) and occupation of the Guest(s);
    • (2) Nationality, passport number, port, and date of entry in Japan;
    • (3) Date and estimated time of departure; and
    • (4) Other particulars deemed necessary by the Hotel.

Article 9 Occupancy Hours of Guest Rooms

  • The Guest is entitled to occupy the contracted guest room of the Hotel from 3:00 p.m. on the day of arrival to 11:00 of the following day. However, in the case when the Guest is accommodated continuously, the Guest may occupy the guest room all day, except for the days of arrival and departure.
  • The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the guest room beyond the time prescribed in the same Paragraph. In this case, extra charges shall apply.

Article 10 Observance of Hotel Regulations

The Guest shall observe the Hotel Regulations established by the Hotel.
Hotel Regulations are posted within the premises of the Hotel.

Article 11 Business Hours

The business hours of the Hotel's main facilities shall be notified in detail by brochures as provided, notices displayed in various places, the Service Directory in guest rooms, and other means.
The business hours are subject to temporary changes due to unavoidable circumstances of the Hotel. In such cases, the Guest shall be informed by appropriate means.

Article 12 Payment of Accommodation Charges

  • The explanation of accommodation charges, etc. that the Guest shall pay is as listed in the attached Table No. 1.
  • Accommodation charges, etc. as stated in the preceding Paragraph shall be paid at Front Desk at the time of the Guest's departure or upon request by the Hotel by traveler's cheques, coupons, credit cards, and other means acceptable to the Hotel.
  • Accommodation charges shall be paid even if the Guest voluntarily does not utilize the accommodation facilities provided for him/her by the Hotel.

Article 13 Liabilities of the Hotel

  • The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in cases where such damage has been caused due to reasons for which the Hotel is not liable.
  • The Hotel is covered by Hotel Liability Insurance to deal with unexpected fire and/or other disasters.

Article 14 Handling when Unable to Provide Contracted Rooms

  • The Hotel shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
  • When arrangement of other accommodation cannot be made, notwithstanding the provisions of the preceding Paragraph, the Hotel shall pay the Guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to reparations.
    However, when the Hotel cannot provide accommodation due to causes for which the Hotel is not liable, the Hotel will not compensate the Guest.

Article 15 Handling of Deposited Articles

  • The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused to goods, cash or valuables deposited at the Front Desk by the Guest, except in the case when this has occurred due to causes of force majeure. However, for cash and valuables, when the Hotel has requested the Guest for an appraisal of the value and the Guest has failed to do so, the Hotel shall compensate the Guest up to a maximum of 100,000 yen.
  • The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused, through intent or negligence on the part of the Hotel, to the goods, cash or valuables brought onto the premises of the Hotel by the Guest but are not deposited at the Front Desk.
    However, for articles of which the nature and value have not been reported in advance by the Guest, the Hotel shall compensate the Guest up to a maximum of 100,000 yen.
  • The Hotel cannot accept deposits of items such as works of art and antiques.

Article 16 Custody of Baggage and/or Belongings of Guest

  • When the baggage of the Guest is brought into the Hotel before his/her arrival, the Hotel shall be liable to store it only in the case when such a request has been accepted from the Hotel. The baggage shall be handed over to the Guest at the Front Desk at the time of his/her check-in.
  • When the baggage or belongings of the Guest are found after check-out, as a general rule the Hotel shall wait until the owner contacts the Hotel inquiring about them and then ask for instructions. When no such instructions are given to the Hotel by the owner or when ownership is not confirmed, valuables and items containing personal information shall be delivered to the nearest police station within 7 days, including the day of discovery.
  • The Hotel's liability in regards to the custody of the Guest's baggage and belongings in the case of the preceding two paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of Paragraph 2.

Article 17 Liability in Regard to Parking

  • The Hotel shall not be liable for the custody of the vehicle of the Guest when the Guest utilizes the parking lot within the premises of the Hotel, as it shall be regarded that the Hotel simply offers the space for parking, whether the key of the vehicle has been deposited to the Hotel or not. However, the Hotel shall compensate the Guest for damage caused through intent or negligence on the part of the Hotel in regards to the management of the parking lot.
  • The Hotel cannot bear any responsibility for a vehicle left in a parking lot it does not manage (referred to below as an “affiliated parking lot”), nor for the theft, loss, or damage to accessories or loaded items.
  • The Hotel cannot bear any responsibility for any damage or loss by the user of the affiliated parking lot caused by another user of the affiliated parking lot, or a vehicle present in the affiliated parking lot or caused by accessories on it, loaded items, or the like.

Article 18 Liability of the Guest

  • The Guest shall compensate the Hotel for damage caused through intent or negligence on part of the Guest.

Article 19 Disclaimers

  • Communications from the Hotel using the internet, email, and other means utilizing a personal computer, mobile telephone, or other devices is at the responsibility of the guest. The Hotel will not bear any liability for any damage or loss the user may incur due to system failure, radio interference, power failure or other reasons while using these means of communication. Furthermore, in the event the Hotel or third parties incur damage or loss due to actions taken that the Hotel deems to be inappropriate in advance or after the fact, the Hotel will demand compensation for that damage or loss.

Remarks:

  • Basic Accommodation Charges are based on the Table of Charges displayed on the Hotel's website.
  • The Hotel charges the same for children as adults, but no charges apply when children elementary school age or younger are not provided bedding and meals. However, there are times when Children’s Charges are applied depending on the season and accommodation plan. In such an event, notification will be made by appropriate means.

Remarks:

  • The percentages are based on the cancellation charge to the Basic Accommodation Charges.
  • When the number of days contracted is reduced, cancellation charges for the first day shall be paid by the Guest regardless of the number of days shortened.
  • When part of a group booking (for 15 persons or more) is canceled, the cancellation charge shall not be charged for persons in the booking equivalent to 10% (with fractions rounded up) of the total number of persons if cancellation is made 10 days prior to occupancy (when accepted less than 10 days prior to the occupancy, as of the date).

Conditions for Accommodation

Hotel Regulations

The Hotel has established the following regulations pursuant to Article 10 Observance of Hotel Regulation in order for guests to be able to enjoy a safe and comfortable stay.
We ask that guests pay particular attention to these regulations since if a guest does not observe these regulations, the Hotel has no choice but to refuse accommodation or use of its various facilities, and may even hold the guest liable for the loss the Hotel suffers.

Matters Related to Safety and Security to be Observed

  • Please be aware of the evacuation route map that is indicated on the inside of the entrance door of each guest room.
  • During your stay, please make sure to lock the door when leaving the guest room.
  • During your stay, use the inner key and a door chain, particularly when going to bed. When a visitor arrives at your door, identify the visitor through the peephole without opening the door. If you cannot identify the visitor, please call the Front Desk.
  • Do not smoke in areas not designed in the Hotel for smoking. Do not conduct any other activity that could otherwise cause a fire. If you smoke in a non-smoking, you will be charged the actual costs for cleaning and repairing the bedding, curtains, wallpaper and other items and fixtures, as well as other costs.
  • Do light a fire, candles or anything else for heating or cooking in the guest room or hallway without permission from the Hotel. Furthermore, cooking inside the room is strictly prohibited (except in rooms where cooking facilities are provided).
  • Guests are requested not to invite visitors into the guest rooms.
  • It is strictly prohibited for visitors who are not registered as Guests to stay overnight in the Hotel.
  • Even if you do not desire your room to be cleaned, it will be cleaned once every 3 days for reasons of maintaining hygiene. However, the Hotel may clean your room any time it deems necessary.
  • Criminal gangs, radical action groups or similar organizations or members belonging to them may not use the Hotel. (Should it become evident after a reservation has been placed or while the Hotel is in use that it is being utilized by such elements, at that point use of the Hotel will be denied.)

Regarding Handling of Valuables and deposited Items

  • There is a safe (safety deposit box) in the guest room. For safety’s sake, the Hotel recommends guests store their important items, valuables, cash, and other such belongings in the safe. However, it is the responsibility of the guest to check to make sure the items are secure in the safe while it is in use. Please be aware that the Hotel shall not compensate the guest in the unlikely event the items be destroyed, damaged, lost, or suffer similar consequences while stored in the safe.
  • In principle, if a guest has not given specific instructions regarding their forgotten and lost times that we keep in storage, we shall handle them according to established laws and regulations.

Regarding Payment

  • Settlement of accounts shall take place at the Front Desk upon arrival or whenever requested by the Front Desk.
  • Charges shall be paid by traveler's checks, accommodation coupons, and credit cards accepted by the Hotel. Cash, promissory notes, and checks are not accepted.
  • Please contact the staff at the Front Desk in advance when the length of your scheduled accommodation changes. When you extend your stay, we ask that you make the required payments up to that point.
  • The Hotel shall not make payments on behalf of the Guests for shopping, airfares, train and bus fares, taxi fares, postage, costs of sending luggage, or any other expenses.

Prohibited Activities

  • Please do not bring any of the following items that may inconvenience other Guests into the Hotel:
    • (1) all types of animals and pets, such as dogs, cats, and birds (excluding but not limited to guide dogs and service dogs);
    • (2) combustible or inflammable items, such as gunpowder, volatile oil, and other hazardous products;
    • (3) items with an offensive odor or strong odor;
    • (4) firearms, swords, or stimulant drugs;
    • (5) extremely large amount of luggage or other articles; and
    • (6) other belongings prohibited by the laws and regulations in Japan.
  • Do not gamble or conduct activities that may disturb moral order or peace and order, or behavior that may inconvenience other Guests or cause them displeasure in the Hotel.
  • Do not use guest rooms or the lobby for purposes other than lodging, such as sales and marketing activities, without the permission of the Hotel.
  • Do not hang articles that deface the appearance of the Hotel out the window, or to display them by the window.
  • Do not distribute advertising or promotional materials, or sell goods on the premises of the Hotel without permission.
  • Do not use facilities or furniture and fixtures in places or for purposes other than the designated places or intended purposes, such as reallocating them in the Hotel, or use them in a way that significantly alters the current appearance.
  • The shooting of photographs or video inside the Hotel on its premises that disturbs or inconveniences other Guests is strictly prohibited. Furthermore, the public display without permission of photographs and other media recorded in the Hotel may be subject to legal action.
  • Avoid leaving personal possessions in the corridor or lobby.
  • Except during emergencies or other unavoidable situations, do not access areas that are not for Guest use, such areas for Hotel employees, escape stairways, rooftops, and machine rooms.
  • For reasons other than force majeure, in the event a Guest damages or contaminates the building and structures, or damages, contaminates, or loses furniture, fixtures or other articles in the Hotel, the Hotel may seek reimbursement of the equivalent amount of damage or loss.
